Final Rule Regarding Arbitration Agreements with Long Term Care Facilities

The Centers for Medicare and Medicaid Services (CMS) have issued their final rule regarding arbitration agreements between residents and Long-Term Care facilities. This rule states that a resident cannot be required to sign a binding arbitration agreement in order to receive care or be admitted to the long-term care facility.


If a resident is about to sign an arbitration agreement, they must understand what they are signing and must know that not signing the agreement is not a condition on whether they would be admitted or continue receiving care at the facility.
